Before me is an application for interlocutory injunction filed by the Plaintiff/Applicant. The Plaintiff’s case as gleaned from his pleading and affidavit in support of the instant application is that it acquired the land in dispute by an assignment dated 10th September 2016 from Overtaken Company Ltd. According to the Plaintiff, its vendor obtained its grant from the Odoi Kesse family of Obosomase-Akuapem. Plaintiff further claims that after it had acquired the land in dispute, it permitted the Defendant to operate his fitting shop on a section of the land with the understanding, that he could not put up any structures on the land and would surrender same to Plaintiff on request. Plaintiff claims Defendant has breached this agreement by developing the land in spite of warnings issued by the Plaintiff.
