GOD'S MERCY CONSTRUCTION LTD. AND KOJO KUMAH vs. MINISTRY OF EDUCATION & 15 ORS.

In this motion on notice the 3rdDefendant/Applicant (hereinafter called the Applicant) is praying this court to strike out his name from the writ, as he is not a necessary party to the suit. The background to the application is that on 2nd February, 2018 the Plaintiffs/Respondents, hereinafter referred to as “the Respondents” issued a writ of summons claiming against the Defendants the following reliefs: a. An amount of GHC900,096.27 being the cost of work executed pursuant to an agreement entered into between the Defendants and Plaintiffs to construct a two storey building which will serve as fence wall around Prempeh College, Kumasi but which agreement Defendants have subsequently abrogated and destroyed the work executed by Plaintiffs. b. Interest on the said GHC900,096.27 from November, 2018 till date of final payment. c. Damages for breach of Contract. d. Cost. e. Any order(s) the Honourable Court may deem fit.
