IRENE FYNN WILSON vs. THE REPUBLIC
This is an appeal from the judgment of the Circuit Court, Takoradi delivered 14/03/2018. The appellant has been arraigned before the court for: 1. Stealing contrary to S. 124(1) of Act 29/60 as amended; and 2. Fraudulent breach of trust contrary to S. 128 of Act 29/60 as amended. At the end of the trial the appellant was found guilty on both counts, convicted and was sentenced to 2 years IHL on count 1 and 5 years IHL on count 2, respectively. Being dissatisfied with the judgment of the lower court, the appellant has appealed to this court on 2 grounds, namely: i) That the facts and evidence led at the trial clearly cannot support the conviction. ii) That the sentence is unreasonably harsh. Brief facts: Briefly stated, in July 2014, the complainants in the case upon some agreement with the appellant, advanced to the appellant an amount of Ghc90,000.00 intended for a purchase of a house.
