ERIC BUDU vs THE REPUBLIC
JUDGEMENT MENSAH-HOMIAH, (J. A.): This is an appeal against the sentence imposed by the High Court, Accra, in its judgment dated 30th April, 2014. The Appellant and his two accomplices were charged with the offences of: 1. Conspiracy, contrary to Section 23 (1) of the Criminal offences Act, (Act 29) 2. Robbery, contrary to Section 149 of the Criminal Offences Act, (Act 29) as amended by the Criminal Code (Amendment) Act, 2003 (Act 646). All the three Accused persons pleaded not guilty. After a full trial, they were convicted and sentenced to fifteen (15) years imprisonment on each count to run concurrently. This appeal pertains to the sentences imposed by the High Court. The facts of the case as presented by the Prosecutor are that on 18th November, 2010 at about 1:00 p.m., the Complainant, Razak Adamu, whilst on his normal rounds as a taxi driver, was stopped by the Appellant (A1) and two others.
