HONYENUGA, JA On the 10th December, 2019, we delivered judgment in favour of the Plaintiffs and the judgment of the High Court dated, 20th December 2013, was varied in favour of the 2nd Defendant/Respondent. We proceed to give reasons for that judgment. This is an appeal against the judgment of the High Court (Land Division), Accra, dated the 20th day of December, 2013. The learned trial judge had entered judgment for the 1st plaintiff on all the reliefs claimed and awarded a total costs of GH¢15,000.00 against the defendants. Dissatisfied by the judgment of the High Court, the 1st defendant has filed an appeal to this Court on the 18th day of March 2014 based on the following grounds: “(a) That the judgment of the Court is against the weight of evidence. (b) The trial Judge erred in Law and in fact in holding that the Nungua Stool was aware of Suit No. L383/89 and sat by hence estopped from re-litigating the matter.
