PROMISE EMEKA vs. THE REPUBLIC

POKU-ACHEAMPONG JA: This is an appeal against both conviction and sentence by an Accra High Court. In a judgment dated 29th January, 2010 the Appellant and three others were convicted on two counts of conspiring to rob and robbery contrary to sections 23 (1) and 149 of the Criminal Offences Act 1960, Act 29. The facts of the case are that on 25/2/2006 at about 1.00am the appellant, the 4th accused person in the case and four others invaded the house of the complainant Ms. Joyce Opoku Boateng, a lawyer at West Legon, Accra inflicted cutlass wounds on her, beat her and her family mercilessly and robbed her of the following items. Konica Camera; two mobile phones, jewellery, a ………….containing valuable documents and ¢1,500,000 old Ghana Cedis. All the accused persons escaped after the robbery.
