JUDGMENT BY WELBOURNE, JA This is an appeal against the Ruling of the High Court, Accra, dated the 22nd day of July, 2015. BRIEF FACTS: The facts in this case are fairly simple and straightforward and same narrated by the 1st Defendant/Appellant as follows: In the early 1960’s the Government acquired a large tract of land for the purposes of generating electricity by means of the water power of the Volta River; initial compensation sums were paid by the VRA in the 1960’s and in August 1974, State Lands (Volta River Flooded Area) Instrument, 1974 E.I. 98 as amended by State Lands (Volta River Flooded Area) (Amendment) Instrument, 1975 E.I. 67 was passed to (formally) compulsorily acquire an approximate area of 3,400 square miles of land in the Volta, Eastern, Brong Ahafo and Northern Regions (Pai, Apaaso, Kete Krachi, Makango, etc.) already inundated by the Volta Lake.
