This is a motion on notice for leave to issue a Writ of Possession and Fifa combined and to attach the judgment in this case instead of the Writ of summons and statement of claim. Plaintiff/Judgment/Creditor (hereinafter called Plaintiff) in this suit issued a Writ of summons supported by a statement of claim in April 2009 against the Defendant/Judgment/Debtor (hereinafter called the Defendant) which was later amended in June 2009 for the following reliefs: 1) An order declaring the 2 bedroom house built by the Defendant on Plaintiffs land as unauthorized and illegal. 2) Recovery of possession 3) Damages for trespass 4) Perpetual injunction restraining the Defendant, his assigns, privies, assigns, servants, workers, children and any other persons claiming through or under the Defendant from interfering with the Plaintiff’s property at Adenta in any way. 5) Any further or other orders as this court will deem fit.
