RULING ON APPLICATION FOR SUMMARY JUDGMENT This application is a request to the Court to enter final judgment against the defendant on the reliefs sought by the plaintiffs. The application is brought under Order 14 rule 1 of the High Court (Civil Procedures) Rules, 2004 (CI 47). The Court has read both motion paper and supporting affidavit and perused all annexures. The Court has also considered the affidavit in opposition filed by the defendants and also the submissions of both learned Counsel and has adverted its mind to Order 14 rule 1 of CI 47. The Court believes this application should not be granted because there are issues in contention between the parties herein which must be ironed out through the adduction of evidence especially concerning whether the Exhibits B, C1, C2 and C3 annexed by the plaintiffs to their application were really authored by the late Isaac M. Darpoh since the defendants are claiming that the handwriting on the said exhibits is not that of the deceased...
