HIGH TRUST GHANA LTD. vs. ACCRA METROPOLITAN ASSEMBLY

This application is a request by the garnishee/applicant (the National Investment Bank) for an order of this Court staying execution of its garnishee order which was given on the 21st day of January, 2020 and to also set aside the said garnishee order absolute. The said garnishee order absolute was given in respect of the account of the defendant/judgment/debtor which is domiciled with the applicant herein. The applicant’s main reason for this request is that the defendant/judgment/debtor is also indebted to the garnishee/applicant in the sum of GH₵12,104,870.43 and therefore the applicant herein has no amount standing to the credit of the defendant/judgment/debtor for which same can be given to the plaintiff/judgment/creditor/respondent herein.
