1. THE DECISION Upon a careful consideration of all the evidence before it, this Court is of the opinion that the plaintiff herein is entitled to judgment on the reliefs endorsed on his writ of summons and statement of claim. The reasons for coming to such a conclusion will be demonstrated anon. 2. FACTS OF CASE The facts of this matter are that the plaintiff, a Ghanaian who is ordinary domiciled in the United Kingdom, in the year 2004 bought a piece of land at Apenkwa from one Mark Obiri who is now deceased. The lease in respect of the said land was for a period of fifty (50) years commencing from 1st July, 2004. Later on in the year 2005 the Ghana Highway Authority notified property and land owners in that area that the Government of Ghana intended to carry out an extension of the motorway from the Tetteh Quarshie Roundabout through Apenkwa to the Mallam Junction.
