RULING ON APPLICATION FOR GRANT OF AN ORDER OF SUBPOENA TO ISSUE This application is brought by the defendant herein and it is a request to the Court for a grant of an order for subpoena to issue against the Executive Secretary of the Lands Commission to enable the said person to testify in this matter by tendering a certain document called a ‘consent letter from the paramount stool of Ngleshie Alata Traditional Council’. The applicant claims this letter will help the Court in the resolution of the matters in dispute. The plaintiff is opposed to this application and says a grant of same will be unfair to him since the defendant’s application is misconceived and lacks legal basis. The Court has considered the application and the affidavit in opposition and also the submissions of both counsel and the Court is of the opinion that it should not close its eyes to any evidence that will assist it to determine or resolve all issues in contention in the substantive case and in any...
