This application is a request by the plaintiff for an order of interlocutory injunction against the defendant to restrain him and his agents etc. from entering on the land in dispute pending the final determination of the substantive mater. The defendant is opposed to the application. The Court has considered the affidavits and exhibits of both parties and also the submissions of learned counsel on behalf of both parties and the Court is of the opinion that it is appropriate that both parties are restrained from having anything to do with the land in dispute pending the final determination of the substantive suit because there are triable issues to be resolved between the parties e.g. as to who actually owns the land in dispute and whether there was any fraud perpetrated by the plaintiff. Both parties are therefore restrained from dealing with the land in dispute pending the final determination of the substantive suit. No cost awarded in this proceeding. (SGD) JUSTICE ANAND...
