Motion on notice for an order for joinder of Emmanuel K. Adjei to suit as 2nd defendant The applicant requests this Court for an order joining him to the substantive suit as a 2nd defendant. The reason for his request as can be garnered from his original affidavit and supplementary in support of his application is that the land, the subject matter of dispute between the plaintiffs and the defendant herein, is the property of the Otopa We family of which he is the acting head and that it is the said family that granted the land to the defendant. The applicant claims the said family obtained judgment in the High Court some time ago concerning the land in dispute (Exhibit 1 attached to the motion paper and supporting affidavit). The applicant thus believes that he ought to be joined to the present suit to enable him protect the interest of his family and to also avoid a multiplicity of suits.
