ENGEN GHANA LIMTED vs. MAGNA LOGISTICS COMPANY LIMITED AND MR. SAMUEL BANNERMAN
This is a Ruling on an Application to join Mr. Samuel Bannerman as 2nd Defendant to this action. The facts at hand are that this suit commenced on the 25th of July, 2018 with a writ of summons and statement of claim endorsed with the following reliefs; a) An order for the recovery of an amount of GH¢430,616.95 owing by the Defendant to the Plaintiff. b) Interest on the said sum at the agreed contractual rate from 06/02/2017 till the date of final payment. c) Cost inclusive of lawyer fee. THE CASE OF THE PLAINTIFF The case of the Plaintiff is relevant for our purposes because it is important to determine the application before this court. It is the case of the Plaintiff that it is a body corporate which deals in the refinery of crude oil, marketing of refined petroleum products, lubricants, supply and trade of petroleum products.
