KWAME AMANKWAH-TWUM vs. PASSION AIR AND DAC INTERNATIONAL AIRLINES LIMITED
The court stood this case down to 3:00pm for ruling. In actual fact it was actually not necessary and could have been dealt with when the matter was called this morning. The court at that time had not had the opportunity to read through the proceedings of 25th November, 2019. Having done so I must be very candid that the resolution of this matter lies simply on the authority of Ex parte Salloum 2011 SCGLR and the fact that the applicant had not been duly served before the order was procured. This has nothing to do with business names and Companies Act, it is a simple matter of the court not having jurisdiction simplicita. Thus the application is granted as prayed. The court expresses its regret of having to let counsel come back at 3:00pm for what could have been dealt with in a sentence or two when the matter came up to be heard this morning.
