Introduction/Background [1] The Applicant, Ashie Nikoi by the instant application is praying for an order of this Court pursuant to Sections 110 and 111 of the Alternative Dispute Resolution Act, 2010 (Act 798)for the registration of the “Customary Arbitration Award dated 12th May, 2019 and for leave to enforce the “arbitral award dated 12th May, 2019”. The central issue is whether this Court should grant the application for the enforcement of the said arbitral award pursuant to Act 798. ii. Position of the Parties The Applicant [2] The Applicant has deposed that he is a native of La, a local town in Accra and owns a parcel of land situate and lying at La upon which the Respondents herein had trespassed. According to the Applicant he has a lease agreement which shows that he is the owner of the parcel of land which the Respondents have trespassed.
