i. The Applicant’s Case: [1] This is an application by Counsel for and on behalf of the 2nd Defendant herein praying for leave to file a “supplementary witness statement in order to tender a pen drive on the 2nd Defendant’s supervision of the development of the Forest View Lodge at Abrafo – Odumase near Cape Coast and the Family House of the Plaintiff at Bodumase near Kumasi from the bare ground to a Hotel complex and from the bare ground to a 5 storey building upon the grounds contained in the accompanying affidavit in support”. [2] It is noted that the Plaintiff and his witnesses have already testified and been cross-examined by Counsel for the Defendants. The 2nd Defendant has completed his evidence-in-chief and his witness statement filed on May 16, 2018 has been adopted by the Court.
