EM CAPITAL PARTNERS vs. ECOSAFE GHANA LIMITED & ANOR OFFICIAL LIQUIDATOR

i. Introduction/Overview: [1] This application is another episode in the continuing legal drama between the Applicants/Judgment Debtors and the Plaintiff/Judgment Creditor, and now the Official Liquidator as the Interested Party. This legal battle was commenced sometime in 2015 by the Plaintiff against the Defendants. Since that time, the Applicants and the Plaintiff/Judgment Creditor have been engaged in this litigation which has produced many applications and rulings including two Interpleader proceedings filed by Mrs. Selina Fatima Owusu, the spouse of the 2nd Defendant and Barclays Bank Ghana Limited. The result of the long litigation undoubtedly led to the mounting debts of the Plaintiff Company which is now in liquidation. The Interested Party/Respondent herein has been appointed the official liquidator as a result.
