EDGRACE RECYCLING SERVICE vs. PSC TEMA SHIPYARD LIMITED

i. Introduction: [1] This action arises out of the Plaintiff’s inability to gain access to the vessel Motor Tanker (MT) Kemepade/Tanen, which it purchased to scrap and sell for profit in line with its main business. The Plaintiff contends that even though by a Court order the Defendant was directed to release the vessel to the Plaintiff it refused to comply with the order. As a result the Defendant Company’s officers were cited for Contempt of Court and convicted. It is the case of the Plaintiff that the Defendant by its conduct caused the vessel to be attached and sold causing it significant financial losses. The Plaintiff seeks General and Specific damages and an order for the recovery of the amount of $469, 756.00 United States Dollars or its Cedi equivalent among other reliefs endorsed on the writ of summons. ii.
