Introduction: [1] The Plaintiff, Ms. Ogochukwu Nnenne Ezeanya, is a trader who says she plies her trade between Ghana and Nigeria. The Plaintiff contends that in July 2018 the Defendant who was a friend approached her to assist him to raise some money to invest in his business. She says she assisted the Defendant with substantial sums of money and executed an agreement by which the Defendant used his properties as collateral. It is the case of the Plaintiff that the Defendant has defaulted but when she attempted to rely on the agreement signed the Defendant resisted with threats. The Defendant on his part denies receiving any money from the Plaintiff and also denies using his properties as collateral for the money claimed by the Plaintiff. The Defendant further contends that his signature on the disputed agreement in possession of the Plaintiff was procured by fraud.
