LATEX FOAM RUBBER PRODUCTS LIMITED vs. GHASSAN LABA

i. Introduction: [1] The Plaintiff’s Writ of Summons and Statement of Claim were filed on 6th December, 2018. On January 15, 2019 this Court granted the Plaintiff leave to serve the Writ of Summons and the Statement of Claim by substituted service on the Defendant and same was complied with. On May 13, 2019 the Court granted the Plaintiff Default Interlocutory Judgment against the Defendant for not entering appearance and ordered the Plaintiff to file a witness statement, and attach all documents it intended to rely on in proving the case. The Court also granted the Plaintiff leave to serve a copy of the order together with the witness statement to be filed. On June 26, 2019 a Notice of Conditional Appearance being appearance under protest was entered on behalf of Defendant herein but no step was taken thereafter. On January 15, 2020 the Defendant filed a Motion on Notice to set aside the Writ of Summons and the Statement of Claim. This Court by a ruling dated March 25, 2020 dismiss.....
