JOSEPH OKOH ABBEY vs. JOSEPH ODOI AKOGYERAM, JEDDY MANNU AND KAROU TAMAL

On the 7/11/13 the plaintiff caused a writ to be issued out of this Court against the 1st and 2nd defendants herein for. a) An order directed at the defendant to give vacant possession of the said Macbay Spot (Now La Beach Bar) to the plaintiff. b) Outstanding rent at $1,000.00 or its equivalent in cedis per month from the 9th of July 2013 to date of payment. c) Costs. By his statement of claim the plaintiff averred that per an agreement dated 3/12/07 he leased his spot commonly called Macbay Spot at the La Pleasure Beach to one Karou Tamal for 4years but the commencement date was later changed to 10/7/2009. He stated that Karou Tamal paid a total of $24.000.00 for the four (4) years which was to expire on 9/7/2013. It is the plaintiffs case that after the expiration of the 4years he found the 1st and and 2nd defendants in occupation of the spot even though he had given Quit Notice to Karou Tamel.
