RULING Counsel for 1st Respondent has filed affidavit in opposition. It has been served on the Applicant’s counsel. Counsel for both parties have prayed the court to rely on the submissions filed and give its ruling in accordance with Order 25 Rule 1(6) of CI 47. I have gone through the application for injunction filed by the Plaintiff/Applicant (hereinafter called the Applicant) in this case. I have also gone through the pleadings filed so far, as well as the exhibits attached to the application and the affidavit in opposition to the application. It is trite law, that injunction can be granted under Order 25 of CI 47 either before, during or after a case. In granting or refusing an injunction, the factors which the court will consider are balance of convenience and whether it would be fair and just to grant or refuse the application. It can also be granted or refused where the party against whom it is granted can be compensated at the end of the case. See: ODONKOR AND OTHER.....
