JON BONFUL vs. OBUASI MUNICIPAL ASSEMBLY

By a writ of summons and statement of claim filed on the 23rd day of January 2017, the Plaintiff claimed against the Defendant as follows: (a) A declaration that the date of commencement of the Agreement signed sometime in 2009 during the National Democratic Congress tenure in government but dated 1st June 2005 between the plaintiff and the defendant for fifteen (15) years is indeed 1st June 2005 as stipulated in Article 1.1 of the said agreement and not a contrary date as forcefully asserted by the defendant. (b) A declaration that the decision of the defendant announced at the 17th May 2016 meeting with the tenants of the plaintiff at the conference room of the Assembly is unlawful, illegal and an infraction of the plaintiff’s constitutional and common law rights. (c) An order of the Honourable Court compelling the defendant to adhere to the terms and stipulations of the agreement dated 1st June 2005 but signed sometime in 2009 between the defendant and the plaintiff.
