POKU-ACHEAMPONG, J.A.: This is an appeal against a judgment of a Kumasi High Court dated 3rd June 2019. The Plaintiffs/Respondents who shall hereinafter be referred to as the Plaintiffs issued a writ of summons against the Defendant/Appellant hereinafter referred to as the Defendant on 15th June 2006 claiming the following reliefs: a. Declaration of title and ownership of House number plot No. 4 Block 11, Aboabo, Kumasi. b. Damages for trespass. c. Perpetual Injunction restraining the Defendant, his agents or servants or any other person claiming interest in the property through him from in any way interfering with the Plaintiffs’ title and possession and occupation in the disputed house and in attempting to eject and or ejecting the tenants and occupants of the said house. On 10th June 2006 the Defendant filed his Statement of Defence and counterclaimed for the following: a. A declaration of title, possession, occupation and ownership of H/No Plot 4 Block 11, Aboabo/Kumasi. .....
