KWADJO BRIGHT vs. THE REPUBLIC.
ANTHONY OPPONG JA: The appellant was the second accused (A2) in the court below. He was charged with six others on three counts of conspiracy to commit robbery contrary to section 23(1) and 149 of Act 29/60; robbery contrary to section 149 of Act 29/60 and another robbery contrary to section 149 of Act 29/60 as amended by Act 646/2003. The appellant pleaded not guilty to all the three counts. After trial however, the trial High Court on 27th July 2010 found the appellant guilty and sentenced him to 35 years on each count to run concurrently The appellant being dissatisfied against the sentence filed this appeal pursuant to leave granted by the court below on 25th June 2019. The grounds of appeal found at page 65 of the record of appeal are: (a) The trial Court failed to consider the various mitigating factors in passing its sentence against the appellant (b) That the sentence given the appellant is excessively onerous.
