CLETUS CHIDI NDUKWE vs THE REPUBLIC

JUDGEMENT MENSAH-HOMIAH, JA: The appellant herein, Chidi Ndukwe, alias Chidi Emeka @ Kofi Asare Patrick, was charged with the offences of conspiracy to commit robbery & robbery as well as possession of fire arms & ammunitions without lawful authority, contrary to sections 23(1), 149 and 192 of the Criminal offences Act, 1960 (Act 29). His co-accused person, Paul Onyeka, has however not filed an appeal before this court. The appellant was arraigned before the High Court, Accra on 14th November, 2008. He pleaded guilty to the charges and upon his conviction, he was sentenced on 12th December, 2008 to Thirty (30) years IHL on counts One and Two; and Twenty-Five Years (25) on Count Three, to run concurrently. Being dissatisfied with the Sentence, the appellant filed a Notice of Appeal at the Court of Appeal, Koforidua, pursuant to an order of this Court dated 4th May, 2021. on the following grounds: a.
