JUDGEMENT MENSAH-HOMIAH, JA: INTRODUCTION This appeal is at the instance of the 1st Accused/Appellant (hereinafter referred to as Appellant) against the Judgment of the High court, Ho dated 15th January, 2018. It is for mitigation of sentence. The Learned High Court judge considered an appeal lodged by the Appellant herein against the sentence imposed on him by the Circuit Court, Ho, having been convicted of the following offences: (i) conspiracy to commit crime to wit defrauding by false pretence contrary to section 23(1) and section 131 of the Criminal offences Act, 1960 (Act 29); defrauding by false pretence contrary to section 131 of Act 29; and Issue of False Cheque contrary to section 313 A (1) of Act 29.
