1.0 INTRODUCTION: The Plaintiffs together with the 5th Defendant, their biological brother, are all administrators of the estate of the Late Madam Victoria Amerley Quaye and it is in that capacity that they sued the Defendants. 1.1 The 1st, 2nd, 3rd and 4th Defendants have allegedly trespassed onto the disputed property and the 5th Defendant is alleged to have facilitated the trespass of the other Defendants onto the property and hence this action against all of them. 1.2 FACTS: The facts of this case are very straight forward and also simple. The Plaintiffs claim that their late mother, Madam Victoria Amerley Quaye, duly acquired the disputed property from one Alfred Ayitey Ansah in 1999.
