1.0 INTRODUCTION: On the 13th of January, 2017, the Plaintiff caused to issue for himself and as the Administrator of the estate of the late CHARLOTTEE CLASS-PETER and WILHEMINA ESI AKWEI at the Registry of this Court, a writ of summons claiming the reliefs indorsed on his said writ of summons against the Defendants herein. 1.1 Per the indorsement on the writ of summons, the Plaintiff sought (i) Declaration of title (but without describing the land for which the title was being sought). (ii) Recovery of possession. (iii) Perpetual injunction to restrain the Defendants, assigns, agents from interfering with the land or the property situated on the land. (iv) Mesne profits (to be assessed) and (v) Damages (but there is no indication as to what type of damages the Plaintiff was seeking.
