NICHOLAS KUMI DANSO vs. NII TETTEH KOFI AND 3 OTHERS

1.0 INTRODUCTION: Per the indorsement on the Plaintiff’s writ of summons which he caused to be issued for him on 4th September, 2013, the Plaintiff claimed for declaration of title/ownership of ten (10) plots of land situate at Nsakina, Accra the boundaries of which were aptly described in the indorsement on the writ. The Plaintiff also seeks recovery of possession of the land granted to the 4th defendant by the 3rd Defendant, but his relief for general damages is against the 4th Defendant only. 1.1 The writ was accompanied by a 21-paragraph statement of claim in which the Plaintiff explains in detail the basis of his action against the Defendants 1.2 FACTS: The facts of this case are simple or straight forward. According to the Plaintiff who describes himself as a Public Servant, sometime in 2003, the Head of family of Nsakina (now deceased), acting per his Lawful Attorney executed a lease for him and that the 3rd Defendant, styling himself as a leader of the family has now .....
