1.0 BACKGROUND: On 22nd February, 2019, the Plaintiff caused to issue from the registry of this court a writ of summons against the Defendant herein seeking the reliefs endorsed on the said writ of summons. 1.1 In line with the dictates of C.I. 47, particularly Order 2 rule 6 thereof, the writ was accompanied by a statement of claim stating in details the events that gave rise to this cause of action. 1.2 Due to some circumstances in the registry of this court, the writ somehow could not be served within the time allowed for the service of same. The Plaintiff therefore had to bring an application to extend the life of the writ before its expiry and this court differently constituted, after finding the said application to be meritorious, extended the life of the dying writ which was all this while in intensive care for another twelve (12) calendar months, beginning from 24th February, 2019. 1.3 After the life of the writ had thus been extended, the Plaintiff came to face another c...
