VIDA SACKEY vs. NII KPAKPO SAMUAH
1.0 INTRODUCTION: By a writ of summons dated 22nd July, 2009, the Plaintiff a Ghanaian domiciled in Canada and suing through her lawful Attorney sought declaration of title to the land she described in relief (a) of her endorsement. She also sought recovery of possession of the land, damages for trespass, perpetual injunction and cost. 1.1 The writ was accompanied by a Statement of Claim made up of 10 paragraphs in which statement the Plaintiff explained in full detail the basis for her claim. 1.2 Upon the service of the writ and the Statement of Claim, the Plaintiff the Defendant initially failed to enter appearance thereby making the Plaintiff obtain judgment in default of appearance against the Defendants. 1.3 Later, upon an application by the 1st Defendant, the default judgement was set aside paving the way for the 1st Defendant to cause a late appearance to be entered for him by his legal counsel and to also then file his Statement of Defence. 1.4 Later, the Plaintiff discon...
