THE REPUBLIC vs. AKOA KOFI OWUSU ACHIAW, EXPARTE: SYNDICATED CAPITAL FINANCE LTD

JUDGMENT The Applicant on the 3rd June, 2021 filed the present contempt proceedings against the Respondent for an order committing the Respondent to prison on the grounds that an order of the Court was flouted by the Respondent. The genesis of the case is that in Suit No. CM/BDC/0076/2021 the Plaintiff therein now the Applicant in this contempt application sued the Respondent together with a Company called ACHWEK LTD for the following reliefs; (a) An order directed at the Defendants to deliver up the equipment purchased by the Plaintiff or value (b) The payment of the sum of Thirty Million five hundred and Ninety five thousand and eighty-two Ghana Cedis, thirty-three pesewas (Ghc 30,595,082.33) (c) Interest (d) Any other relief that the Court may deem just, proper and convenient to order in particular, and for cost including legal expenses.
