JUDGMENT The Applicant on the 9th June, 2021 filed a motion on notice for an Order committing the Respondent for contempt of Court. The contempt application has its roots from the case with suit No. C1/41/2020 instituted by the Applicant then as Plaintiff against the Respondent and a Company known as BLU CONSULT LIMITED. In the said suit the Applicant claimed from the Respondent and the Company a declaration of title to land with building situate thereon, recovery of possession and or ejection, perpetual injunction, damages for trespass, damages for breach of contract as well as for cost. THE APPLICANT’S CASE The Applicant’s case is that the building in dispute which is at Kwabenya was allocated to the Applicant after she entered into a contract with the BLU CONSULT LTD for the construction of a house by the Company and the sale of same to the Applicant.
