JUDGMENT By his amended writ of summons accompanied by a statement of claim filed on 22nd January, 2021 the Plaintiff claimed from the Defendant Company the following reliefs; (a) A declaration that the Plaintiff was not the cause, by way of negligence or by any other way, of the fatality incident that occurred at the Obuasi Mine on the 22nd October, 2015 and in the premises, should not be held responsible for the same. (b) A declaration that the fatality incident that occurred at the Obuasi Mine on the 22nd October, 2015 was an industrial accident resulting from gross systemic deficiencies in the general operations at the said mine .
