JUDGMENT Plaintiff’s case By a writ of summons issued on 9th July 2021, the plaintiff claimed the following reliefs against the defendant: i. A declaration that the refusal of the defendant to let plaintiff into possession of the disputed property since its acquisition in 2016 is most unreasonable and unlawful. ii. An order directed at the defendant to let the plaintiff into possession forthwith. iii. Damages for unlawful conduct. iv. Mesne profit. v. Costs including cost of litigation. vi. Any other order as the honourable court may deem just and proper. It is the case of the plaintiff that sometime in the year 2006, he saw an advertisement which was auctioning a parcel of land with a building thereon situate at Cantonments Residential Area, Accra for sale.
