RULING Introduction By a writ of summons issued on 21st August 2020, the plaintiff claimed among others that the judgment obtained by the 1st defendant in Suit No. LD/1149/2019; Caroline Afua Ahotor v. Emmanuel Amaniampong was obtained by fraud and deceit and further that the judgment was also void as the plaintiff in that suit failed to state his residential address on the writ. The plaintiff has therefore called upon this court to set aside the said judgment on the ground of fraud and for also being void. The plaintiff further went on to claim that he is the rightful owner of the land, the subject matter of this suit which was also the subject matter of the judgment in Suit No. LD/1149/2019. He also claimed for a declaration of title, damages for trespass, recovery of possession, injunction and costs. The 1st defendant duly entered appearance and filed a defence.
