RULING Plaintiff’s Case By a writ of summons issued on 6th May 2021, the plaintiff claimed among others, the reliefs of declaration of title, recovery of possession, injunction and exemplary damages against the defendants. The plaintiff describes himself as the head and lawful representative of the Apaintse We of the Lenshie Quarter of La and his family has from time immemorial been in possession of the Shiashie lands including the land in dispute. The plaintiff asserts that on 1st September 1944, the Colonial Government through the Public Lands Ordinance, Cap 134 compulsorily acquired his family lands for the construction of an airfield. The plaintiff asserts that upon the said compulsory acquisition, all rights or interests in the land were extinguished and Government acquired an absolute and indefeasible title in the land but the Government failed to eject his family from the land and as such they continued to occupy the land as trespassers.
