ASARE KORANTENG vs. TRUE POWER ELECTRICAL ENGINEERING LTD.

JUDGMENT Introduction This case has stayed in the court for almost twelve years. The original writ was issued on 8th June 2009 against one Emmanuel Kumi, the Managing Director of the defendant company. The writ was later amended on 10th January 2011 to add the current defendant as a 2nd defendant. The suit proceeded between the plaintiff and the said defendants until on an application brought by counsel for the defendants which was heard on 21st December 2020, the 1st defendant was struck out as a party to the suit leaving the 2nd defendant as the only defendant to the suit. The suit has had a chequered history as on one occasion, the plaintiff’s suit was struck out for non-compliance with orders made at case management. The suit was later relisted on an application by counsel for the plaintiff. The suit suffered a further set back when the original docket mysteriously disappeared from the court.
