RULING This is an application for and on behalf of the caveator hereinafter referred to as the applicant praying the Court not to include House No. C105/2, Akim Oda in the self-acquired properties of the deceased as same is the property of the Aduana, Asomkahene branch family of Akim Oda. Per the affidavit of interest, the applicant is the nephew and customary successor to the late Samuel Boadi Attafuah. That house No. C105/2, Akim Oda which was included in the estate of the deceased is not the property of the deceased. That the said property is the property of the Aduana, Asomkahene branch family of Akim Oda, of which the applicant is a principal member and so house No. C105/2, Akim Oda being a family property cannot be included in the estate of the late Samuel Boadi Attafuah.
