THE REPUBLIC vs. KOFI ATTA & 3 ORS EX PARTE: OPANIN KWABENA AGYAPONG

JUDGMENT On 6th January 2020, the applicant through his counsel filed a motion under Order 50 of the High Court (Civil Procedure) Rules, C.I. 47 for an Order for contempt against the respondents. I shall quote the relevant paragraphs as follows: 1. That I am the deponent herein and plaintiff in suit No. C1/11/2017 entitled OPANYIN KWABENA AGYAPONG VRS KOFI ATTA, YAA HANNA, KWAME MIREKU. 2. That in the afore-mentioned suit I claimed the following reliefs: a. A declaration of title and recovery of possession of all that piece or parcel of land situated and lying at a place commonly known and called ‘Kyayem” on Akimg Gyadam stool land and bounded by the properties of Opanin Donkor (dec’d), Opanin Kwasi Boadu (dec’d), Opanin Kwadwo Anarkwa and the other side by Madam Afua Serwaa. b.
