The National Labour Commission at its sitting of 20th January, 2021 heard the Complaint of “Unfair Termination” lodged by Benjamin Tsiwah , Complainant against PW Mining International Gh. Ltd . Respondents COMPLAINTS CASE: The Complainant Submitted that: 1. He was employed on 28th May, 2015 as a Dump Truck Driver. On 28th November, 2016 he was taken ill and admitted at the Okomfo Anokye Hospital. 2. The Company illegally set up a medical board to assess him (the Complainant). Per the Workmen's compensation Act, it is the Chief Labour Officer who is mandated to set up a Medical Board. 3. The recommendations of the illegally constituted Medical Board was not made known to him (the Complainant). Management communicated a document elated 15th January, 2018 for him to go for surgery. 4.
