RE: IN THE MATTER BETWEEN DDP LOCAL UNION OF GCMQQU/TUC And DDP OUTDOOR LIMITED
We refer to the disputing parties' appearance before the Commission on 10th June, 2021 at which the above-mentioned dispute was heard. Complainant's case: The Complainant Union submitted as follows that: 1. Every year the Union negotiates annual bonus with the employer. 2. On 17th December, 2020, the CEO said he would not pay bonuses because the target was not met. 3. The Union met the Board to inform them about the happenings but to no avail. 4. The local union had a discussion with management on 15th January, 2021, stating emphatically that the Union was not going to accept bonus less than 100% of their basic salary. 5. As spelt out in clause 28 of the Collective Agreement (CA), the prerogative of the employer for bonus payment comes into play when pre-communicated target is discussed with staff. 6.
