The above-named dispute was heard by the Commission on 24th February, 2021. At the hearing the parties appeared. Complainant's Submissions: The complainant submitted that he was charged for failing to obey lawful instructions following which he was queried, and that when he submitted his response he was put before a Disciplinary Committee and thereafter he was dismissed from employment. Respondent's Submissions: The case of the Respondent was that in the year 2016 complainant who was employed by respondent company failed to obey lawful instructions from his supervisor. He was employed as a porter and his duty was to load and/or offload cargo from aircrafts. On the particular day, the event of which led to his dismissal, they were three loaders who were instructed to check and offload cargo but they refused so he was queried and he responded with an apology.
