On 24th February 2021, this Court differently constituted ordered submissions to be filed in respect of a preliminary legal objection by the Defendant Respondent (hereinafter called the Respondent). The legal objection was in respect of a motion the 3rd Party/Appellant/Applicant (hereinafter called Applicant) filed in this case. The motion is seeking to set aside the two rulings of this Court dated 30th October 2020, or in the alternative to stay their execution. The Respondent’s legal objection is to the effect that; the Applicant should not have filed the motion in the first place. Therefore, the Court should dismiss them in limine and not to consider their merits. The Respondent in its submission filed on 4th March, 2021 prayed the Court to allow its preliminary legal objection on the following grounds: - a. That by virtue of Article 137 of the 1992 Constitution, it is the Court of Appeal which is seized with jurisdiction to entertain the application and not the High Court. .....
