On 22nd October, 2020, the Defendant/Applicant (hereinafter called the Applicant) filed a motion on notice praying for an order striking out the statement of claim and dismissing the entire action upon the grounds stated in the affidavit in support. The Applicant prayed further as follows: - The instant action is founded on a contract which had expired at the time the Plaintiff’s cause of action allegedly arose thus, the Plaintiff’s statement of claim and the entire action does not disclose a reasonable cause of action, is frivolous, vexatious, and an abuse of the process of the Honourable Court.
