JOHN OSEI BONSU vs. NANA YAA GYAMA

The suit which has given birth to this appeal was filed by the Plaintiff/Respondent (hereinafter called the Respondent) on 19th March 2014. The Respondent in his writ of summons against the Defendant/Appellant (hereinafter called the Appellant) claimed for the following reliefs: a) Recovery of possession of plot number GA 28, Suame Magazine, Kumasi. b) An order for ejectment from plot GA 28, Suame Magazine, Kumasi. c) An order for perpetual injunction restraining the defendant and or her agents or anybody claiming through her from in anyway dealing with the above named plot in dispute. The Appellant resisted the Respondent’s claim in her statement of defence and counterclaimed as follows: a) That plot number 27, block ‘F’, Suame Magazine is vested in her and her daughter Victoria Asante as personal representatives of the later Asante Bekoe. b) Perpetual injunction restraining the plaintiff his representatives, agents, assigns, workmen from interfering with the right of the...
