KWAME FOSU vs. THOMAS NANA OFORI (SUBT. BY GEORGE MANU), AFUA ABRAFI AND TABI AGYEI AMPONSAH

The Plaintiff in his amended writ of summons filed on 3rd November 2014 claims against the Defendants for the following reliefs. i. A declaration that the purported sale of plot number 77 ‘A’ Antoboase-Obuasi by the 1st and 2nd Defendants to the 3rd Defendant is null and void and of no legal effect as they have no legal right to sell same. ii. Damages for trespass. iii. Perpetual injunction restraining the Defendants from interfering with the plot of land in dispute. The Defendants entered appearance and filed their defence. At the close of pleadings, the following issues were set down for trial. a) Whether or not the property numbered Plot No. 77 ‘A’ Antoboase was gifted to the late Kwaku Krah by his uncle the late J.A Kwaah. b) Whether or not the necessary documents covering the said property were prepared in the name of the late Kwaku Krah. c) Whether or not the late Thomas Nana Ofori and the 2nd Defendant have the right to sell the property in dispute to the 3rd D...
